The Australian government's mandate on Autonomous Emergency Braking (AEB) post-March 1, 2023, played a pivotal role in the Scorpio N's unexpected score. Mahindra strategically registered the SUV before this date, exploiting a regulatory loophole. However, this strategic move has now backfired, as the ANCAP penalizes the Scorpio N for lacking the essential safety features.

The ANCAP rated the Scorpio N 17.67 out of 40 points (44 percent) for adult occupant protection and safety. While certain tests showcased stability, critical areas such as the frontal offset and side impact tests revealed weaknesses, with inadequate protection for the driver's chest and poor protection for the rear passenger's head, neck, and chest. Child occupant protection received a relatively better rating, but ANCAP raised concerns about missing top tether anchorages in specific seating positions.

In the vulnerable road user protection section, the Scorpio N received a mere 23% safety rating (14.94 out of 63), highlighting the weaknesses in the pedestrian protection. Additionally, the absence of Autonomous Emergency Braking (AEB) contributed to the Scorpio N scoring 0 out of 18 under the safety assist section.
